Introduction

Welcome to Cooture! These Terms of Use govern your access to and use of the Cooture mobile application and its associated services (the "Services"), provided by S. SELLEST, a Société par Actions Simplifiée (SAS) with a share capital of €2,000, registered at 12 Rue de la Part-Dieu, 69003 Lyon, France — RCS Lyon 922 789 771 ("Cooture", "we", "our", or "us").

By downloading the App, creating an account, or using any of our features, you agree to be bound by these Terms. If you have any questions, please contact us at support@cooture.app. If you do not accept these Terms in their entirety, you must not access or use the Services.

PLEASE READ THESE TERMS CAREFULLY TO ENSURE YOU FULLY UNDERSTAND EACH PROVISION.

General Provisions

Users

The term "you" refers to any individual who downloads, accesses, or uses the Cooture App. By creating an account, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement. If you are under 18, you confirm you have obtained parental or guardian consent.

Subscriptions

Certain features of Cooture are available through a paid subscription. A subscription grants you access to premium features for the duration of the selected subscription period, as displayed in the App at the time of purchase.

Privacy and Data Protection

By using the Services, you acknowledge that your personal information — including photos and generated images — will be processed in accordance with our Privacy Policy.

Use of Services and Restrictions

License Granted to You

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Cooture App strictly in accordance with these Terms. This license does not include any right to resell, sublicense, or commercially exploit the Services.

Your Content and Creations

You retain full ownership of all clothing images, photos, and content you upload to Cooture, as well as all AI-generated try-on visuals produced using your content ("Your Creations").

By using the Services, you grant Cooture a limited, non-exclusive, revocable license to process your uploaded images and photos solely to deliver the requested features (wardrobe management, outfit creation, AI try-on generation). Cooture does not claim ownership of your content and will not use your personal photos or generated images for marketing purposes without your explicit consent.

You retain the right to use, share, or export your Creations freely outside of Cooture without any restriction.

Restrictions on Use

You agree not to use the Services to:

• Upload images of other individuals without their explicit consent;
• Generate content that is harmful, abusive, sexually explicit, discriminatory, or otherwise unlawful;
• Import or reproduce clothing images in violation of third-party intellectual property rights;
• Use automated systems (bots, scrapers, etc.) to access or extract data from the Services;
• Attempt to reverse-engineer, decompile, or tamper with any part of the App;
• Damage, disable, or disrupt the functioning of the Services;
• Transmit spam, malware, or any unauthorized communications through the Services.

We reserve the right to suspend or terminate accounts that violate these restrictions, without notice.

Third-Party Content Imports

When importing clothing items from external websites or online stores, you are solely responsible for ensuring you have the right to use and reproduce those images within the App. Cooture does not endorse or verify the intellectual property status of third-party content imported by users.

Storage of Your Content

You are responsible for managing your wardrobe content within the App. While we implement measures to protect your data, we do not guarantee the permanent availability of stored items and recommend keeping your own backups of important images.

Payment Obligations

Payment Terms

Access to Cooture's premium features requires a paid subscription. Subscription fees are displayed within the App prior to purchase and are non-refundable unless otherwise required by applicable law.

Billing Policy

By subscribing, you authorize Cooture (or our payment provider, RevenueCat) to charge your selected payment method on a recurring basis according to your chosen billing cycle. You are responsible for keeping your payment information up to date.

Payment Processing

Payments are handled by RevenueCat in conjunction with the Google Play or Apple App Store billing system. We do not directly store your full payment card details.

Cancellation

You may cancel your subscription at any time through your device's Google Play or Apple App Store subscription management settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time in a billing period.

Free Trial

Where a free trial is offered, you will have access to premium features for the duration of the trial period. If you do not cancel before the trial ends, you will automatically be charged for the selected subscription. You may cancel at any time before the trial ends to avoid any charge.

Intellectual Property

Cooture's Intellectual Property

All content, software, design, logos, graphics, trademarks, and other materials that form the Cooture App (excluding Your Content) are the exclusive property of S. SELLEST (SAS) and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of our platform without prior written consent.

Copyright Infringement

If you believe that content available through Cooture infringes your copyright, please notify us at support@cooture.app with a description of the work you believe has been infringed, the location of the infringing content, your contact information, and a statement of good faith belief. We will respond promptly and may remove disputed content at our sole discretion.

Representations and Disclaimer

You represent that you have the legal capacity to accept these Terms and that your use of the Services will comply with all applicable laws and regulations.

The Services are provided "as is" and "as available", without any warranty, express or implied. Cooture disclaims any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that AI-generated try-on results will be accurate, realistic, or meet your specific expectations. You use the Services at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Cooture's total liability for any claims arising from the use of the Services shall not exceed the total fees paid by you to Cooture in the three months preceding the claim.

Cooture shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of data, loss of generated content, or other economic losses, even if Cooture has been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless Cooture, its officers, employees, and affiliates from any claim, damage, liability, or expense arising from your use of the Services, any breach of these Terms, any infringement of a third party's rights through your content or use of the App, or any violation of applicable law.

User Account

Account Creation

To use Cooture, you must create an account by providing accurate and complete information. You agree to keep your account information up to date. Cooture reserves the right to suspend accounts with inaccurate or misleading information.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. Please notify us immediately at support@cooture.app if you suspect unauthorized access to your account.

Communications

By creating an account, you agree to receive service-related communications from Cooture. You may opt out of marketing communications at any time using the unsubscribe link in our emails or through your account settings.

Miscellaneous

Force Majeure

Cooture shall not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including natural disasters, pandemics, power outages, or telecommunications failures. If such an event persists beyond 30 days, either party may terminate the agreement without penalty.

Modifications to the Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Your continued use of the Services after the effective date of updated Terms constitutes your acceptance of the changes.

Governing Law

These Terms are governed by the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lyon, France.
